yes this was filmed in breezy conditions. To the subject at hand. I have now been "investigated" by the FAA twice in 6 months for flying on, near or around the Cape Cod Canal. A 7 mile long waterway situated between Cape Cod and the mainland of Plymouth, MA. It is run by the Army Corp of Engineers and has been for some time. It is publicly accessible 24/7, 365 by boat, bike and walking. There is no check in, no gates, no locks and no restrictions on ANY video or photo equipment. Security concerns? Ha! I can take a DSLR with a telephoto lens and take as many photos and video with it and post them online...However the ACE has seen fit to "ban" drones not only from their property but also a mile out into cape cod bay and more than that going into buzzards bay. Now I have spoken with 7 different pilots - all with over 25 years of actual flight experience and 4 of them also teach drone classes to obtain a 107 license and were and when to fly and so on and ALL of them say the ACE has ZERO right to what would essentially close the airspace on or around the canal. It is not restricted airspace, nor is it on ANY app, website or chart as a no fly zone/restricted in any way. I understand keeping safe distance from the infrastructure like the bridges and so on but to try and tell me and others that they control the airspace above what is essentially public property....AND the whole one mile out beyond the canal itself if overreaching, and I for one am tired of it. Any ideas and or thoughts? Also the FAA closed both "investigations" with nothing more than saying - this is what the ACE relayed to me - follow the rules - excuse me what? The FAA is the only branch of govt that can restrict airspace! I flew under 400ft in both cases, flew within line of sight, did not fly over people...and of course flew for hobby purposes.......I am tired of the back and forth and I am most tired of the ACE trying to assert authority when it has none! From all the reports, regulations AND speaking with said individuals it is clearly by definition NOT a restricted area to fly a drone and the ACE can say what they want...I will continue to fly there. Oh and there are none..ZERO signs posted...captains of Coast Guard ships, tugs, hell even the U.S Navy appreciate and enjoy my content. MMA and its cadets as well as the staff and parents also enjoy the footage.......so why..WHY is the ACE telling me one thing...were everyone els is saying the opposite.
